Are You Ready For A Car Crash?

  safe-1142432_1920You know the drill after an auto crash, heart stopping panic, and then, especially if there’s major damage or a serious injury, exchanging names, addresses and insurance information with the other driver. Easy, right? However, if the other driver refuses to provide these particulars (or you’re so shaken that you forget to ask for them), you could end up in serious financial, or even legal, trouble. Dan Young, Senior Vice President of Insurance Relations for CARSTAR warns, “[After an accident] sometimes drivers just don't do what they’re supposed to do." To make sure you’re prepared for such a mishap, follow these guidelines:
  • Remain at the scene. Although state laws differ, failure to exchange information or notify police can lead to a hit-and-run charge or loss of your license.
  • Keep a “cheat sheet” in your glove compartment about what to ask after an accident.
  • Use your cellphone to take a photo of the other vehicle, (preferably showing its license plate) as visual proof of the incident.
  • Write down details. As soon as you and your vehicle are out of traffic and harm's way, record the date and time, location, make and model of the cars and actions or statements by the other driver.
  • Ask any bystanders or eyewitnesses for their names and contact information.
In the meantime, review your auto policy to make sure that you carry: 1) collision coverage, which will pay for repairing your car and providing a replacement vehicle, if needed and 2) uninsured/underinsured motorists insurance (UM/UIM), which will cover damages for injuries caused by an uninsured or underinsured driver. THE ABC’S OF HOLD HARMLESS AGREEMENTS

Bookmark and Share Because construction projects are complex operations involving a number of subcontractors under your supervision, onsite accidents or injuries resulting from their work can easily lead to litigation against you. To protect yourself against claims, losses, and expenses if disputes arise during the project, make sure that all subcontractors sign a “Hold Harmless Agreement” clause. The terms of these clauses will vary from state to state. In some cases, this clause will protect the contractor from claims by corporations or companies that did not sign the agreement. There are three types of hold harmlessagreements: Under the Broad Form, the subcontractor assumes all liability for accidents due to negligence of the general contractor, and combined negligence between the two parties. Because of its sweeping terms, this form is relatively rare – and some states prohibit it. With the Intermediate Form the subcontractor takes on all liability for accidents and negligence, but will not be held accountable for the general contractor's actions. It doesn’t matter whether the incident was the subcontractor’s fault. If both parties were negligent, the subcontractor assumes liability all for its acts or omissions. Intermediate form agreements are relatively common. A Limited Form agreement makes the subcontractor liable only for the proportional part of its responsibility for a mishap. Other parties – such as subcontractors – will be held liable under their hold harmlessagreement(s) for their corresponding part of the accident or negligence. The type of agreement that’s best suited for your needs will vary depending on the nature of the project and state laws. As always, we stand ready to offer you our professional advice.

Floods, Cars, And Auto Insurance

Floods happen - and nearly half of all deaths related to them involve vehicles, says the Federal Emergency Management Agency.

The best advice for drivers during periods of heavy rain or flooding is to stay off the road. If that's not possible and you see signs of high water or stranded vehicles, pull over or take a different route ("Turn around, don't drown").

However, an unexpected flash flood can easily catch you unawares. If this happens, safety experts recommend taking these precautions to prevent an accident or a water-damaged car:

  • Never drive beneath an underpass during a heavy rainstorm because they're prone to flooding.
  • Be wary of water levels. According to FEMA it takes only one foot of water to float a car, or even an SUV, sweeping it off a bridge or down a road.
  • If your vehicle gets caught in a flood and stalls, or you lose control, get out before the car is carried downstream.
  • If you can't escape and your vehicle is going under, don't panic. Once the car is submerged, open the doors, hold your breath, and climb out.

The good news: If your car is involved in a flood-related accident, Auto insurance can make sure that you don't get swept away financially. Comprehensive coverage will pay for any type of damage to your car up to its actual cash value caused by natural events, such as flooding. Underground Construction Risks: The 811 Solution

Across the nation, utility lines, tunnels, and structures run under our feet, Each year, excavators strike approximately 700,000 of these underground lines, often triggering potentially fatal accident (from steam, gas, propane, or electricity). A single strike might easily cost a contractor hundreds of thousands, or millions, if the accident leads to an interruption of service that shuts down a factory, hospital, telecommunication lines– even a missile silo. In most cases, insurance will not cover these losses. To deal with this threat, the Common Ground Alliance coordinates 811 --Call before You Dig, a nationwide phone and online system that contractors can use to notify local utilities so they can "mark out" their facilities before excavation of anything from to a sewer to a subway. These markouts are required under state law. When you use the call 811.com system, bear in mind that:
  1. It doesn't matter where you are - downtown, in the middle of a suburban street, or building a private home.
  2. Call even if you're confident that you know where something is buried (for example, if you installed the line); many contractors dig up lines that have just put in.
  3. Instead of marking the area with wooden stakes - which are all too easy to drive through gas lines - use white paint or "feathers;" even the most shallow excavation can be hazardous.

Car Insurance Deal-Breakers: Non-Renewal And Cancellation

aquaplaning-83008_1280If your Auto insurance company sees you as a deadbeat or high-risk or driver, it might cancel or non-renew your policy.

Because insurers take cancellation seriously they won't eliminate coverage for a traffic ticket or two. What's more, state regulators ban cancellations under most circumstances. However, a company can non-renew your insurance at the end of each policy period (six to 12 months) or cancel the policy during the first 30 to 60 days that it's in force. The main reason for midterm cancellation is nonpayment. State regulators set the requirements, such as a written notice of non-payment, together with a 10 to 30-day grace period to pay. Some states allow insurers to cancel coverage, usually for an activity - such as a DUI conviction that involves bodily injury or substantial damage - which indicates you're at high risk for an accident; or for misrepresenting your driving history (for example, not disclosing that your teenager was behind the wheel instead of you when an accident occurred). Some companies will backdate coverage to the cancellation date, while others will not cover you during the period when you haven't paid your premiums. If you can't bring your account up to date or the company cancels you for a reason other than non-payment, your policy probably won't be renewed - which means you'll have to look for insurance elsewhere, probably at a higher rate. Depending on the reason for cancellation, some companies might refuse to write your business. In this case, you can to turn to the state's assigned-risk pool, which offers bare bones coverage at higher rates. Your best move is to do everything possible to avoid cancellation or non-renewal. If your company owns, operates, or uses motor vehicles - or if you have employees who use their cars for business purposes - you need Commercial Auto Insurance to provide financial protection against losses from mishaps that occur behind the wheel. This valuable policy provides these coverages:
  • Bodily Injury Liability pays the cost of bodily injury to others from accidents for which you are responsible. If you're sued, it also pays your defense and court costs.
  • Property Damage Liability picks up the tab for property damage to others for which you are responsible, as well as defense and court expenses.

Auto Insurance: Saving $$ In Your Golden Years

Your Auto insurance rates are based on a variety of factors such as your driving record, mileage, the car you drive and your age.

Rates are highest for drivers in their teens and early 20, tend to fall for those aged 30 to 60-something, and then start climbing again around age 70. Although drivers in this age range tend to drive less and are more mature, their vision and reflexes are declining. They're also more likely to be injured in an accident than their younger counterparts, and to suffer more severely because they're physically weaker. Also. They often drive smaller cars, which are more vulnerable to damage. Here are five ways that senior drivers can keep their Auto insurance rates affordable. :
  1. Update your mileage. You can get a discount of 5% to 10% if you no longer commute or drive long distances.
  2. Use a telematics device. A usage-based or pay-as-you-go Auto insurance program can reduce premiums by 5% to as much as 40%.
  3. Take a class. Most states require Auto insurers to offer "mature drivers" (who can be as young as 55) a discount of 5% to 15% for completing an accident-prevention course.
  4. Exclude a driver. In some states, you might be able to drop coverage on a driver who no longer gets behind the wheel.
  5. Make your car safer. Some insurance companies offer discounts for anti-theft devices, airbags and anti-lock brakes.

Business Property Insurance: Replacement Cost Or Actual Cash Value?

Business Property insurance protects your building and property against loss or damage from theft, accident, and a variety of other causes. The policy will pay for replacing or repairing covered property or providing compensation for irreplaceable items.

If you don't own your building you'll still need to cover its contents: fixtures, furniture, office equipment, inventory and the supplies stored at your location or off-site.

The premium will depend on whether you choose to insure the replacement cost or actual cash value (ACV) of the property. Most Business Property coverage is written on a replacement-cost basis, which will reimburse you for replacing lost or stolen goods with new items at current market prices. This feature can help your business recover from the loss or theft quickly. (If you're leasing equipment, the leaseholder might require you to cover it at replacement value.) You'll need to revise your coverage when you acquire or dispose of property. Be sure to update replacement values over time; a computer worth $1,000 two years ago might cost half that today - on the other hand, the price of a desk might well increase.

Actual cash value coverage, which generally costs less, provides reimbursement for the depreciated value of covered property. If your business owns its own equipment, which you could replace easily with comparable goods at depreciated market value, the lower premium of an ACV policy might make it a more cost-effective choice.

Auto Liability Insurance: How Much Is Enough?

Have you ever wondered about the three numbers that are part of your Auto Liability insurance, usually written in this form: XX/YY/ZZ?

The first number refers to the maximum amount of Bodily Injury Liability (BI) for an individual injured in an auto accident; the second is BI per coverage per accident; while the third covers Property Damage Liability (PD) per vehicle. For example a policy with 30/60/15 Liability coverage would pay up to $30,000 in BI per individual, $60,000 worth of BI per vehicle, and $15,000 in PD per vehicle.

Every state requires drivers to carry a minimum amount of Liability coverage under their Auto policy. Limits by state vary from 10/20/10 in Florida to 80/100/25 in Maine. These numbers have remained fairly stable for a number of years.

However, because a car accident can cost far more than the Liability minimums that most states require, people usually carry more coverage. The Insurance Information Institute recommends that you have at least $100,000 of BI protection per person and $300,000 per accident (known as 100/300).

If you hold the minimum coverage required by your state and you're involved in an accident in another state that requires higher minimum coverage, the chances are that your policy limits will increase automatically to meet the other state's minimum requirements.

Winter Driving Tips

aquaplaning-83008_1280Any travel during winter months is risky. Storms come out of nowhere, roads become icy quickly and inexperienced drivers take unwise risks. Be prepared to stay safe on the road thanks to eight winter driving tips. 1. Check the forecast. In less than a minute, you can find out if you'll be driving in fog, snow or ice. You can also discover which roads are blocked and if you need to find an alternative route to your destination. 2. Slow down. In snowy conditions, cut your speed in half to ensure you have adequate stopping distance. Don't go so slow, though, that you lose momentum on grades. 3. Know skid recovery. Braking on slippery roads can cause your vehicle to slide instead of stop. If this happens, you need to know how to recover. Stay off the brake and steer your vehicle the way you want it to go. 4. Stay smooth at the controls. Pounding on the brake, shifting hard and even clenching the steering wheel make winter driving harder than it has to be. Instead, use smooth motions and relax as you drive. 5. Check your tires. Proper tire inflation and tread improve your vehicle's traction and ability to stay on the wet or icy roads. Check the inflation of your snow tires frequently since cold weather decreases tire pressure, and make sure the tread is at least 1/8-inch. Carry snow chains, too, if necessary. 6. Know your vehicle. Every car and truck handles differently. Before heading out in winter weather, make sure you know how your vehicle handles. Know where the windshield wipers, defrost button and four-ways are, too. 7. Pack survival supplies. If you're stranded or in an accident, you need a few supplies. Definitely store a snow shovel, sand or litter and lock de-icer in your vehicle. Consider packing a portable power source, flashlight, waterproof matches, tow rope, first aid kit, energy bars and blanket also. If you do get stranded, wait for help to arrive. 8. Stay hydrated. Dehydration can make you drowsy and reduce alertness. Drink water before you head out and carry a bottle or two with you so that you can stay alert. Winter driving can be dangerous, but follow these eight tips to stay safe. Remember to check in with your auto insurance agent, too. Update your policy as you prepare for whatever winter throws at you on the road.
