Construction Safety: The 'Correction Conversation'

Safety inspectors know what to look for - but they might need a refresher on holding the "correction conversation": explaining job hazards in such a way that your workers can see the potential danger, understand how it can hurt them, and suggest how to eliminate it. To have an effective Correction Conversation, we'd recommend that safety inspectors follow these guidelines:
  • Try to make it personal. "Kneeling on the floor for the day is going to turn your knees into jelly in a few years."
  • Tie the hazardous activity or condition to pain. "This night watchman dropped his flashlight, and when he bent down to pick it up, the rebar went right through his eye."
  • Make comparisons. These cable clamps might work, but the fist-grips kind are the ones that should be used. See - they look like two fists gripping."
  • Shift the blame. "I'm not sure who set this up, but because those cable clamps are upside down they won't hold much. Just flip them over and torque them again."
  • Connect the correction to something the workers can share. Pass along additional information. Keep it simple, and use graphics whenever possible, If the concern is not having an eyewash station near a concrete pour, send a photo of a what a worker's eye looks like after a concrete burn.
  • Share a story. "I can beat that!" This phrase continues conversation in bars across the world. Tell a workplace hazard anecdote that you've heard or witnessed - and then stop talking! Chances are another worker will share a similar story. One-upmanship is a skill we all enjoy, and helps keeps a good Correction Conversation alive.

Car Insurance Deal-Breakers: Non-Renewal And Cancellation

aquaplaning-83008_1280If your Auto insurance company sees you as a deadbeat or high-risk or driver, it might cancel or non-renew your policy.

Because insurers take cancellation seriously they won't eliminate coverage for a traffic ticket or two. What's more, state regulators ban cancellations under most circumstances. However, a company can non-renew your insurance at the end of each policy period (six to 12 months) or cancel the policy during the first 30 to 60 days that it's in force. The main reason for midterm cancellation is nonpayment. State regulators set the requirements, such as a written notice of non-payment, together with a 10 to 30-day grace period to pay. Some states allow insurers to cancel coverage, usually for an activity - such as a DUI conviction that involves bodily injury or substantial damage - which indicates you're at high risk for an accident; or for misrepresenting your driving history (for example, not disclosing that your teenager was behind the wheel instead of you when an accident occurred). Some companies will backdate coverage to the cancellation date, while others will not cover you during the period when you haven't paid your premiums. If you can't bring your account up to date or the company cancels you for a reason other than non-payment, your policy probably won't be renewed - which means you'll have to look for insurance elsewhere, probably at a higher rate. Depending on the reason for cancellation, some companies might refuse to write your business. In this case, you can to turn to the state's assigned-risk pool, which offers bare bones coverage at higher rates. Your best move is to do everything possible to avoid cancellation or non-renewal. How to Deal With Visitor Injury in the Workplace

visitoraccidentMost states demand that businesses, regardless of size, take every reasonable action to keep their premises safe for employees and visitors. The definition of visitors is fairly loose. Basically, it is anyone not employed by the business and covered by its workmen's compensation insurance policy. 

This means that clients, customers, delivery persons, repair persons, outside maintenance contractors and anyone who comes to the business premises needs protection from foreseeable dangers. 

There are different types of people who come into a business and each has a different level of required care for its class of visitors. 

Invitee 

This is a person whose invitation is explicit (by appointment, for example) or implicit (a customer looks at the goods and services for sale in a shop). A business owner's duty to an invitee is to exercise ordinary care and make the property generally safe without any dangerous conditions. 

Licensee 

A licensee in not an invitee or trespasser. An example of a licensee is a party who enters the premises for their own convenience or gratification. Think of a person ducking into your entryway to avoid the rain. The duty of care is far less than for an invitee, and the business is only liable to a licensee for willful and malicious harm. 

Trespasser 

This group of people enter the premises lacking an implicit or explicit invitation. They come on the business property for their own enjoyment or benefit. The only duty of a business owner is a negative one - the business cannot build any mantraps the willfully and maliciously causes a trespasser harm. Many states have an exception to this limited responsibility; if the business anticipates, suspects or knows of the presence of a trespasser it must exercise ordinary care and avoid inflicting injury on a trespasser through any kind of active negligence. 

Common Workplace Visitor's Injuries 

Slip and Fall Accidents 

These are the largest cause of visitor injuries. Injuries happen when a visitor trips, slips or falls and suffer injuries. These accidents often stem from things such as uneven floorboards, electrical extension cords crossing aisles or doorways, spills or liquids on the floor, and poorly installed carpet or carpeting that has tears or rips. 

Negligent Security 

It is normal that businesses have a duty to their invitees to make sure they are safe from foreseeable. A business is liable for the criminal acts of a non-employee when the business fails to keep the premises safe from criminal activity. Usually claims of negligent security stem from places such as: 

  • Hotels
  • Motels
  • Parking garages
  • Apartment complexes
Businesses in high-crime areas (a parking garage in such an area needs adequate lighting, video cameras and warning signs that video surveillance is ongoing, and other security measure as needed. 

Attractive Nuisance 

This is a legal doctrine that applied mostly to children, even if they are trespassers. Hotels with outdoor pools need adequate fencing, a pool cover, locks and lighting, as the pool is attractive for kids to try to use after trespassing. 

Defective Property Conditions 

Businesses are often liable for dangerous or defective conditions. These include faulty elevators, faulty escalators, crumbling stairways and more.

Our focus is to get kids interested in the many outdoor activities that are right here in our back yard. With over forty different organizations represented, there is something for everyone! Monterey Bay Youth Outdoor Day is a nonprofit organization dedicated to educating youth about the countless outdoor activities available in our area. All of us involved with MBYOD have the same goal for the children of today... Our goal is simple, lets get our youth back outside and active! We believe that we live in a unique and amazing region and because of that it is important to teach our children to cherish it. We are looking to encourage youth to be healthy through outdoor activities  and build a better place for the future. In hopes of achieving our goal we hold an annual event at the Santa Cruz Fairgrounds where various companies and organizations can showcase their specialties. The event is totally free and we also raffle off dozens of prizes to the youth in attendance to inspire them to participate in the outdoor activity that they find most appealing. MBYOD 2014 will be held on June 21 from 10am to 4pm, so bring your children to the fairgrounds so they can enjoy the dozens of activities we have to offer! Staying active in the summer months
The arrival of spring and summer means days at the pool, family picnics, baseball and other outdoor activities. Here are some tips to keep your family physically active in the warmer months:
  • Hydrate! Drink plenty of water before, during and after physical activity to avoid dehydration. For low-calorie flavor, add slices of your favorite fruits such as melon, oranges, berries or even cucumber or mint to a pitcher of water and refrigerate for two hours.
  • Protect your family from the sun: wear wide-brimmed hats, always apply water-resistant sunscreen with at least SPF 15 and reapply sunscreen every 2 hours.
  • Heat safety: avoid intense activities between noon and 3 p.m. when the sun is at its strongest.
  • Dress for the heat: wear lightweight, light colored clothing, choose light, breathable fabrics such as cotton, and wear sunglasses to protect your eyes.
  • Head indoors: when the heat gets unbearable, try indoor activities at your local YMCA or rec center like basketball, swimming, yoga or racquetball.

Heart-Healthy Cookout Ideas

Warmer weather may mean it’s time to break out the grill, here are some tips and ideas for a healthier grilling cookout:
  • Go fish! Fish, especially oily fish like tuna and salmon have great nutritional benefits including omega-3 fatty acids. Rub a fillet with lemon juice and parsley or rosemary for enhanced flavor.
  • Make a better burger: if you’re grilling burgers, be sure to buy lean or extra lean beef, drain off the excess fat after cooking and avoid making huge patties – remember that a serving of meat is about the size of a deck of cards (3 oz). Add finely chopped green pepper to your beef to get in some veggies.
  • Baked fries: Slice white or sweet potatoes into sticks, lightly spray with olive oil cooking spray, pepper and paprika and bake on a cookie sheet for 40 minutes at 375 degrees.
  • Veggie kabobs: load up skewers with mushrooms, peppers, cherry tomatoes, zucchini, yellow squash or other veggies. Spray lightly with olive oil cooking spray and grill until slightly blackened.
  • Try grilled corn on the cob: leave the husks on, and grill for about 30 minutes over medium flame, rotating occasionally. Remove from grill, let cool for about 5 minutes, remove husks and enjoy!
Healthy Road Trip
Road trips can take a toll on everyone – here are some ideas to keep things healthier while on the open road:
  • Make “rest breaks” active: pick a road stop or park and get the family out of the car to take a brisk 10-minute walk and move around. Not only will it burn off some energy, but it can also help the driver feel rejuvenated and more alert.
  • Pack healthy snacks: finding healthier snacks at road stops can be difficult. Pack apples, grapes, raisins, whole grain fiber-rich crackers or another favorite low fat, low sodium healthy snack to take with you.
  • Pack to play: plan to incorporate regular physical activity into your daily routine while you’re away from home. Pack a football, soccer ball, Frisbee, or paddle balls so that you can be physically active throughout your downtime.
  • Reach for water: sitting in the car for long periods of time can make it tempting to drink soda, which has extra calories and added sugar. Pack water (flavored or regular), fat free or lowfat (1%) milk and small portions of 100% juice to quench your thirst.

Summer Snack Ideas

Try some fun and refreshing summer snacks that the entire family can enjoy:
  • Fruit pops: Homemade freezer pops are an easy, fun treat for kids to make. Mash up fruit like peaches, grapes, berries or watermelon and put them in paper cups, insert a popsicle stick, freeze overnight and enjoy!
  • Cool and crisp: keep a variety of colorful veggies on hand that stay cool and crunchy for   a refreshing treat – baby carrots, cucumber slices, and celery sticks are just a few ideas.
  • Fruit smoothies: blend your favorite fresh fruits with fat-free or low-fat yogurt and ice for a refreshing drink or freeze and eat with a spoon like a frozen ice chill.
  • Mix it up: make your own trail mix using your favorite unsalted, oil free nuts, seeds and dried fruits (just be sure to keep your servings to 1.5 ounces or 1/3 cup).
  • Just slice and serve: summer months are peek season for most fruits, just slice and serve – the whole family will enjoy the refreshing natural sweetness and juices just the way nature made ‘em!
