Avoid Sticker Shock For Your Teenage Driver

Adding a teenager to your auto policy can raise your rate by more than 40%. The good news: you and your teen can reduce these hikes significantly in a variety of ways:
  1. Get good grades. Most insurance companies offer high school or college students with a B average or better a discount of up to 10%.
  2. Live away from home. Students at college or living at least 100 miles from their parents without a car can usually get a 5%-10% discount.
  3. Take an additional driving class. Although most insurance companies don’t give a discount for mandatory drivers’ed instruction, some companies will reduce premiums by 5% for teens who go to follow-up classes.
  4. Sign a parent-teen driving contract. Your insurer might offer up to a 5% discount if your teen agrees to follow such rules as not driving at night or with friends in the car.
  5. Raise your deductible. However, bear in mind that you’ll have to pay this deductible if your teen driver damages the car. If you repair every ding, you could spend a lot more than you'll save on premiums with a higher deductible.
  6. Reduce or drop some coverage. If you have an older car, you might not need Comprehensive or Collision insurance. Be wary of lowering Liability limits. In most cases, it makes sense to keep Personal Injury Protection (PIP) coverage, which pays medical expenses of anyone injured in an auto accident.
  7. Choose a safe vehicle. The higher the safety rating of your car, the lower your premiums – and the safer your teenager will be behind the wheel.

Employment Practices Liability Insurance: Four Key Questions

You need Employment Practices Liability insurance (EPLI) to protect you from lawsuits filed (justly or unjustly) by anyone who you employ, have employed, or even considered employing.

Before you buy this essential coverage, be sure to ask these questions:
  1. Who is insured? This should include the company as an entity, along with officers, directors, and every type of employee (full-time, part-time, temp, leased, loaned and seasonal). The importance of this becomes clear if you're ever sued for a sexist slur made by temporary receptionist to a job applicant.
  2. What claims does the policy cover? You want coverage for every eventuality: monetary damages, all types of legal proceeding from criminal to regulatory, settlements, judgments, lost pay, defense fees and punitive damages.
  3. How does the policy define "wrongful employment practices" beyond the obvious (sexual harassment and racial discrimination)? Make sure that you have coverage for violations of federal, state, local and common law on employment discrimination;, deprivation of career opportunities; defamation; retaliation, negligent job evaluation, and failure to have an acceptable written employment policy.
  4. What does the policy exclude? EPLI should include wrongful practices that might have taken place before you bought coverage - so you don't have to worry about a suit by that disgruntled vice president you fired three years ago for pilfering paperclips.
A word to the wise: use EPLI as a last line of defense. Risk management for your business should include diversity and sensitivity training. The U. S. You Need to "Call Before You Dig"

What is 811?

Are you a homeowner or contractor? Did you know that you are required to call the number ‘811’ before digging on any property so that you can be made aware of any underground lines (e.g. pipes, cables and associated utilities) buried in the area? Improper digging can lead to damage to underground lines that can disrupt service to an entire neighborhood, harm diggers or excavators, and even incur potential fines and repair costs.

In case you did not know, 811 is the national "Call Before You Dig" phone number designated by the Federal Communications Commission. This number was developed to eliminate the confusion of multiple "Call Before You Dig" numbers because it is easy to use, is the same for every state, and can help protect anyone who does dig from injury, expense and potential penalties.

What Happens After Calling 811?

All 811 calls are routed to a local One Call Center and the affected utilities. The utility will then send crews to the location to mark any underground lines for the homeowner or excavator for free.

Do Most People Call Before They Dig?

Believe it or not, in spite of all the potential danger and damage that can be caused, the answer is "no." According to a recent national survey, 45 percent of American homeowners who plan to dig this year said that they would not call 811 beforehand.*

How to Deal With Visitor Injury in the Workplace

visitoraccidentMost states demand that businesses, regardless of size, take every reasonable action to keep their premises safe for employees and visitors. The definition of visitors is fairly loose. Basically, it is anyone not employed by the business and covered by its workmen's compensation insurance policy. 

This means that clients, customers, delivery persons, repair persons, outside maintenance contractors and anyone who comes to the business premises needs protection from foreseeable dangers. 

There are different types of people who come into a business and each has a different level of required care for its class of visitors. 

Invitee 

This is a person whose invitation is explicit (by appointment, for example) or implicit (a customer looks at the goods and services for sale in a shop). A business owner's duty to an invitee is to exercise ordinary care and make the property generally safe without any dangerous conditions. 

Licensee 

A licensee in not an invitee or trespasser. An example of a licensee is a party who enters the premises for their own convenience or gratification. Think of a person ducking into your entryway to avoid the rain. The duty of care is far less than for an invitee, and the business is only liable to a licensee for willful and malicious harm. 

Trespasser 

This group of people enter the premises lacking an implicit or explicit invitation. They come on the business property for their own enjoyment or benefit. The only duty of a business owner is a negative one - the business cannot build any mantraps the willfully and maliciously causes a trespasser harm. Many states have an exception to this limited responsibility; if the business anticipates, suspects or knows of the presence of a trespasser it must exercise ordinary care and avoid inflicting injury on a trespasser through any kind of active negligence.

Slip and Fall Accidents 

These are the largest cause of visitor injuries. Injuries happen when a visitor trips, slips or falls and suffer injuries. These accidents often stem from things such as uneven floorboards, electrical extension cords crossing aisles or doorways, spills or liquids on the floor, and poorly installed carpet or carpeting that has tears or rips. 

Negligent Security 

It is normal that businesses have a duty to their invitees to make sure they are safe from foreseeable. A business is liable for the criminal acts of a non-employee when the business fails to keep the premises safe from criminal activity. Usually claims of negligent security stem from places such as: 

  • Hotels
  • Motels
  • Parking garages
  • Apartment complexes
Businesses in high-crime areas (a parking garage in such an area needs adequate lighting, video cameras and warning signs that video surveillance is ongoing, and other security measure as needed. 

Attractive Nuisance 

This is a legal doctrine that applied mostly to children, even if they are trespassers. Hotels with outdoor pools need adequate fencing, a pool cover, locks and lighting, as the pool is attractive for kids to try to use after trespassing. 

Defective Property Conditions 

Businesses are often liable for dangerous or defective conditions. These include faulty elevators, faulty escalators, crumbling stairways and more.

Driver collides with boy on scooter in Watsonville

Scurich Insurance Services, CA, ScooterWATSONVILLE -- A 10-year-old Watsonville boy on a scooter was seriously injured Wednesday after he was struck by a driver of a Chrysler PT Cruiser in a crosswalk on Main Street. About 3:25 p.m., a 19-year-old Prunedale woman was driving a purple PT Cruiser north on Riverside Drive toward Main Street when she accelerated to try to make a yellow light, said Watsonville police Sgt. Brian Ridgway. A 10-year-old boy was riding a scooter behind his family in the crosswalk, and she struck him with the car, police said. The front bumper of the car hit the boy on his right side, and the boy was forced on to the hood and then the ground, Ridgway said. Officers were near the crash and treated the boy. He was taken by helicopter to a San Francisco Bay Area hospital where he was in critical condition Wednesday night, authorities said. The woman, whose name has not been released, has cooperated in the police investigation and has not been arrested. Alcohol use was not a factor in the crash, police said. "This investigation in ongoing," said Ridgway.
