Workers Comp Prescription Narcotics Abuse: Fight Back!

4 The use of narcotics in treating injured workers faces heavy scrutiny today - and for good reason. The latest National Council on Compensation Insurance, Inc. (NCCI) Annual Issues Symposium found that:
  • The average cost of narcotics per Workers Comp claim rose from $39 in 2003 to $59 in 2011. This is a rate of 0.79 narcotic prescriptions per claim, up from 0.56 in 2003 - a 14% increase in eight years.
  • More than 5% percent of Comp claims that resulted in at least one prescription for if anymedication included five or more narcotics prescriptions.
To curb the prescribing of narcotics for your injured employees, start by choosing the right Workers Comp physician. In most states, businesses have the legal right to designate the physician that injured employees must use. To find a physician in your area who is board certified in Occupational Medicine, go to http://www.acoem.org/. If none is available, look for a doctor who takes patients on Workers Compensation. In many cases, urgent care clinics make great partners. Once you find a physician, talk to him or her about your business, discuss your return-to-work program and the types of transitional jobs you offer - and ask about their attitude toward prescribing narcotics. Even if state law prohibits you from requiring injured workers to see a specific physician, you can still suggest that they do so. For example, you might say, "Doctor Joan at Acme Urgent Care has treated many of your co-workers and they've gotten better quickly." Selecting a doctor who doesn't dispense drugs and only prescribes narcotics when they're are absolutely necessary can go far to help injured employees get back to work and be healthy and productive as swiftly as possible - while keeping your Workers Comp costs under control.

Pollution Liability: The CPL Solution

Air, water, and soil pollution pose a serious financial threat for contractors. One small misstep can require thousands - or even millions - to clean up. Consider these scenarios:
  • Remodeling a school kicks up dust.
  • Using construction materials generates fumes that pollute the air.
  • Hitting an underground storage tank leads to the release of liquid pollutants.
  • Spraying to remove a bees' nest from a work area releases insecticides.
  • Tying into a sewer line improperly causes sewage to back up.
Your Comprehensive General Liability (CGL) policy provides severely limited protection against these types of pollution claims. Not to worry! Contractors Pollution Liability (CPL) insurance can protect you. (These policies are sometimes written together with Contractors Professional Liability coverage - see the previous article). CPL covers Bodily Injury and Property Damage - whether by settlement or verdict - as well as the expenses of investigating, defending, or settling claims. Most policies also cover the costs of removing or neutralizing pollutants and restoring the damaged property. CPL policies usually include a "hammer clause" that works like this: if the contractor chooses to fight a claim, rather than settle it, the insurance company's liability for damages and claims expenses is limited to what it would have had to pay if the contractor had approved the settlement. As you can imagine, most contractors choose to settle when their insurer recommends this approach. As with Contractors Professional Liability coverage, CPL policies are usually written on a case-by-case basis, with the size of the policy depending on your situation (for example coverage might be worldwide or limited to the U.S). How Can Workers Prove Chronic Pain: Case Studies to Learn From

Unfortunately, you can't actually see chronic pain. You can talk to someone who physically looks fine, yet is claiming they can barely stand up. Since pain is felt differently by different people, medical professionals and laypeople alike have difficulty categorizing and defining the more severe injuries. This leads to confusion and sometimes outright fraud. Let's look at how pain is defined by using a specific case study. A Question of Proof How injured do you have to be to claim injury? Do you have to be constantly writhing in agony or is it only when you make specific motions? These are specific questions that get a bit touchy. Recently, a man who filed for compensation claimed that he needed a wheelchair but was then shown to be out of his home shopping without it (and seemingly without pain) through video surveillance. They also had him on camera performing a number of other activities as well. He was arrested with the possibility of up to five years in jail. Since the amount paid out due to his injury was more than a half million dollars, it's certainly brought about some attention in his area of Florida. The man was a deputy there, and was injured when bending to get his laptop from the trunk of his police cruiser in 2007. After that, he went through surgery and stated that he couldn't walk, drive or bend, which has then been shown to be false by videos. He states that he had always been consistent in reporting his pain to be inconsistent because no two days are alike. He says that while the video may show him driving and running errands, he can only do so in limited ways. He claims his whole life is a mess, with his job ripped out from under him and expenses piling up. It's now up for the courts to decide who has the better claim and what will happen. Employer Tips  No employer wants to follow their employee around constantly to check up on their progress and verify the truth in their claims. Also, it's difficult to accuse someone who's experienced severe injuries of trying to game the system. However, sometimes it's necessary with the case of chronic pain to be more involved. Medical professionals have been shown consistently to raise costs without cause in certain areas where they have direct financial incentives to do so as well. Through questions and visits, you can start to see the character of the person behind the claim as well as the treatment they're receiving. If you do suspect foul play on either side, then your insurance company will be more than happy to help. After all, they stand to lose out on fraudulent claims too.

New Compensation Rating Formula Lowers Premiums For Most Businesses

1 A revision to the formula for calculating Workers Compensation rates is saving premium dollars for companies in a large number of states since the first of this year. The change involves the experience modification ("mod"), the premium credit or debit that businesses receive for their claims experience. The mod compares your claim experience to that of other firms in your industry; if your experience is good, you'll get a premium credit if not, you'll receive a debit. What has changed is the "split point" between the primary and excess portions of a claim. This value is important because the primary portion of each claim has a far larger impact on predicting an employer's mod than does the excess portion. For the past two decades, the split point has been $5,000. However, inflation has both eroded the primary/excess split point and hurt its predictive power; the mod doesn't give enough credit to good experience and doesn't penalize poor experience enough. The change raises the split point to $10,000 in 2013, $13,500 in 2014, and an estimated $17,000 in 2015. In 26 of the 38 states that have approved the new formula, a survey of more than 75,000 businesses by the National Council on Compensation Insurance found that 62% of them will see their rates fall by 5% or less this year. Another 11% will enjoy decreases of 5% to 10%, while rates will stay unchanged for 4.5%. Fewer than one in four (22.5%) - mostly larger businesses - would see a rate increase. Drip, Drip, Drip: Dealing With Water Damage

Of all Homeowners insurance losses, those from water damage are among the most common. Many people often don't consider the potential risks in their own homes until it's too late.

To minimize hazards that can cause water damage claims, we'd like to recommend these steps:

  • Check for leaks. Periodically inspect the area around the refrigerator, washer, dishwasher, water heater, sinks, and toilets for drips, puddles, and discolored, warped, or soft flooring.
  • Pay attention to your water bill. Monthly fluctuations could indicate a leak.
  • Periodically check your water pressure. Water losses often occur due to excessive water pressure. Buy a pressure gauge at your local hardware store, and hook it up to a hose bib. If it's above 65 psi, install a water pressure regulator.
  • Before you go on vacation, take precautions. If temperatures in your area could dip below freezing, make sure that any exposed pipes are insulated, turn off the water supply to individual fixtures, and turn your furnace to low so that the pipes will stay warm enough to avoid bursting.

If you need to file a claim, follow these guidelines:

  • Stop the source of the water by turning off the water main.
  • Call your insurance company immediately. Most companies have staff 24/7 to help you set appointments with contractors who can dry out your house. Your insurer will also send an adjuster to assess the damage.
  • Don't start any major repair efforts until the adjuster has been to your home!
  • Determine what was lost and document it. Even if things were ruined, don't throw them away. Keep pieces of the damaged floor or ceiling, along with any valuable personal property, such as electronics or furniture. At a minimum, take photos or video of the damage.

Working With Third-Party Administrators Helps Control Claims

1 Third-Party Administrator (TPA) adjusters form the front line of defense against unnecessary claims expenses, including such traditional cost drivers as fraud or opioid pain medication addiction. They're the ones who determine how soon employees will mend and return to the job, the length of claims, and whether closing a claim will require additional resources, such as attorney involvement. It makes sense that the more closely you monitor the adjusters of your company's TPA, the lower your Workers Comp claims costs - and premiums. However, adjusters today are running on overload more than ever. In addition to managing larger caseloads, they face growing real-time information demands, increasing communication speed, and expanding regulations - which distract them from such cost-control practices as staying in contact with injured workers. Says one claims adjustment expert, "The fastest way of getting an injured employee to hire an attorney is making them feel like you don't really care about their injury. So you end up with a lot more claims than necessary going to attorneys, which leads to higher claim costs." It makes sense to work closely with your TPA adjuster by following these guidelines:
  1. Interview adjusters before they're assigned to your company.
  2. Review the adjuster's claims notes on a regular basis.
  3. Audit the TPA's services periodically to make sure that the adjuster is meeting your expectations.
  4. Develop close relationships with claims examiners and their supervisors.

1. Buy a utility model. Sporty models or ATVS with bells and whistles look and ride nice, but they may cost more to insure. Utility models are often economical to insure. Likewise, keep in mind that the ATV's mileage, condition and age also affect your premium. 

2. Take a safety course. Most ATV dealers offer safety courses that include a book test and riding instruction. Your insurance company may reward you and anyone who shares your machine for knowing how to navigate your ATV safely in all terrains. 

3. Maintain a clean driving record. Your insurance premium stays low when you operate the ATV safely and only on grounds where you have permission to ride legally.

4. Store your ATV safely. Locking your toy in the garage and installing an anti-theft device on it can reduce your insurance costs.

5. Compare policies. Different insurance companies offer different deductibles, coverage options and rates, so take your time and comparison shop.

6. Use one company for all your insurance needs. Most companies give you a discount when you combine, home, auto and ATV insurance.

7. File claims only when you have to. You pay for insurance so that you can file a claim if you have to, but don't file for every little damage or your premium will rise.

Gutter problems

In an earlier article, we discussed tips to get your home ready for the fall season.  These tips are important, so there could be no potential denial of coverage should you need to file a claim. In this article, we want you to know what happens when you don’t clean out your gutter and the potential damage it could cause.
  • GutterLeaking gutters.  On the extreme side leaky gutters can also cause leaky roofs, mold, and it can rot away at the surroundings.
  • Leaky roofs.  If your gutter is filled with debris, any rain, snow, or ice, won’t be able to go anywhere, causing a leaky (and expensive repair) roof.
  • Basement leaks.  Gutters usually end up at the foundation of the house.  If there is any damage to the run off, then the water can wind up in your basement.
  • Rotted Wood.  Some houses and/or foundations are made of wood.  If the gutter is not properly taken care of, the build-up will cause wood to rot.
  • Cracks in foundation.  Same principle as above.  Any debris left can create cracks in the foundation.

Should you drop collision coverage on your old car?

We're often asked when is a car so old that it's no longer a wise investment to continue buying collision insurance for it. The answer depends on your individual situation. First, what's the true worth of the car? Any repair or replacement costs following a collision will be based on the value of the vehicle at the time of the claim. Also consider your deductible amount. For example, if your car is now worth $2,000 and your deductible for collision claims is $500, insurance will pay no more than $1,500 for your loss.
