Editor’s Column: Managing Is A Balancing Act

I remember my wife and I going to a parenting class and learning the mantra, “firm, but fair.” It's okay to have clear rules in your household and enforce them; however, you want to do so in a fair manner. When we’re clear about the rules, we can be firm. . I'm sure you've shared my personal experience where parents or bosses have punished you for rules you never knew existed –until after you were punished for them!Often, the knowledge is so “commonsensical” to the parent or boss that they just assume the child or the employee know it also. Never mind that it took 20 years for that boss or parent to finally “get it” themselves. When we’re clear on the rules, there’s predictability. There’s integrity. There’s consistency. The rules don't change overnight based on emotions. When we’re out of balance on the side of clarity we’ll see people begin to fear us, rebel against us, and leave us – not a good outcome at home or work! When it comes to being fair, the first thing to remember is that life wasn't designed to be fair, either at work or at home. Life was designed to be a learning lesson. However, fairness has become the filter of today's workplace. Everyone wants to feel they're being treated fairly. ‘A fair day’s pay for a fair day’s work.’ Of course, what might seem fair to me could seem onerous to you. We treat people fairly when we follow the Golden Rule. By asking how we can serve and help others, practicing kindness and compassion despite any differences we may encounter along the way. We understand to separate the conduct from the person. Managers will continue to struggle with employees about work hours, compensation, communication, expectations, safety, insubordination, conflict, and more. Great managers, like great parents, strike the appropriate balance between firm and fair.

Beware Of Negligent Supervision!

Several courts have found yet another way for someone to sue contractors. This term refers to lawsuits against you for alleged failure to exercise proper control over your employers. For example, one of your employees might be accused of injuring others recklessly while driving a truck on company business. A "negligent supervision" suit would claim that you were negligent in hiring this worker because you either failed to discover or ignored the fact that she had a record of reckless driving. You also have an obligation to supervise your staff. Although you can't foresee every incident, a court will look at whether you took reasonable steps to identify and guard against potential wrongdoing by your employees: everything from unsafe behavior on the job site to sexual harassment. It's not only about whether a worker actually committed an offence - it's about what you did to prevent it. To head off liability for negligent supervision, we'd recommend that you:
  • Set and enforce clear guidelines for interviewing and hiring employees.
  • Provide training in conflict resolution and communication. Supervisors need to know when to report certain behaviors and which behaviors to look for, such as verbal abuse, failing to cooperate with supervisors or co-workers .and making inappropriate comments.
  • Conduct regular performance evaluations to address specific behavior or job performance changes.
  • Provide multiple avenues to receive allegations of misbehavior, and have unbiased managers investigate complaints so that no conflicts of interest exist. Investigate every incidents promptly and take decisive action.

EDITOR'S COLUMN: THE HR ALCHEMIST

In one of my favorite new age books, The Alchemist, author Paulo Coelho discusses four obstacles to realizing the journey towards our Personal Legend:

  1. The first obstacle is resignation to failure. We're told from childhood onward that everything we want to do is impossible. In many cases, we're the ones telling ourselves this - and we believe it!
  2. The second obstacle is misunderstood love. Says Coelho, "We know what we want to do, but are afraid of hurting those around us by abandoning everything in order to pursue our dream." In a sense, we're afraid to change because the people around us might not love us as much if we do. For example, they might view us as a threat, mirror our own inadequacies, or break away from the norm or culture. Coelho encourages us to accept that love is a stimulus; that the people who truly love us want the best for us: to be worthy of the miracle of life.
  3. The third obstacle is the fear of failure. According to Coelho, "We warriors of light must be prepared to have patience in difficult times and to know that the Universe is conspiring in our favor, even though we might not understand how." In my personal experience, when we follow our passions we get what we ask for - just not when or how we expect it. There is no journey without roadblocks, setbacks, and challenges. This is what strengthens us. Our character is no different than our muscles: You use it or you lose it.
  4. Finally, there's the obstacle of self-sabotage. As Oscar Wilde said: "Each man kills the thing he loves." According to Coelho, the mere possibility of getting what we want fills our souls with guilt. We ask ourselves, "Who am I to be so fortunate when there are so many people in pain? Do I somehow think that I'm now better than other people because of my success?' The ancient Greek term was hubris. When we become too full of ourselves and our accomplishments, the end is near. That's why the journey is never about arriving, but traveling forever. Says Coelho, "I've known a lot of people who, when their personal calling was within their grasp, went on to commit a series of stupid mistakes and never reach their goal - when it was only a step away." I know many of those people too.

When you think about your career, where have these obstacles shown up? Where do you have personal doubts about your ability to accomplish your Personal Legend? Who or what is attempting to hold you back from meeting these goals - or is this a story of your own making? Are you willing to accept that the journey toward success is guaranteed to come with more suffering than for those who are willing to simply be comfortable? Finally, are you willing to find joy in your success without the need to sabotage it?

Car Insurance Deal-Breakers: Non-Renewal And Cancellation

aquaplaning-83008_1280If your Auto insurance company sees you as a deadbeat or high-risk or driver, it might cancel or non-renew your policy.

Because insurers take cancellation seriously they won't eliminate coverage for a traffic ticket or two. What's more, state regulators ban cancellations under most circumstances. However, a company can non-renew your insurance at the end of each policy period (six to 12 months) or cancel the policy during the first 30 to 60 days that it's in force. The main reason for midterm cancellation is nonpayment. State regulators set the requirements, such as a written notice of non-payment, together with a 10 to 30-day grace period to pay. Some states allow insurers to cancel coverage, usually for an activity - such as a DUI conviction that involves bodily injury or substantial damage - which indicates you're at high risk for an accident; or for misrepresenting your driving history (for example, not disclosing that your teenager was behind the wheel instead of you when an accident occurred). Some companies will backdate coverage to the cancellation date, while others will not cover you during the period when you haven't paid your premiums. If you can't bring your account up to date or the company cancels you for a reason other than non-payment, your policy probably won't be renewed - which means you'll have to look for insurance elsewhere, probably at a higher rate. Depending on the reason for cancellation, some companies might refuse to write your business. In this case, you can to turn to the state's assigned-risk pool, which offers bare bones coverage at higher rates. Your best move is to do everything possible to avoid cancellation or non-renewal. 11 Ways To Help Your WorkersS Manage Stress

4 You can't eliminate the stress that your employees bring to work - but you can offer them these guidelines to help manage workplace stressors on their own:
  1. Prioritize, streamline, delegate, and discard. When facing a task, ask if it's really necessary to do immediately.
  2. Break things up. Take two - to three - minute breaks every hour and commit to doing at least one fun thing every day.
  3. Make time. Build time into your schedule for creative expression, healthy eating, moderate daily exercise, hanging out with friends, and enjoying nature.
  4. Be on time. Build in cushion time between appointments to allow for traffic and the unexpected.
  5. Send negativity flying. If a co-worker is on the warpath, visualize an airplane with an ad banner over the person's head, with each negative word floating up into the banner and out of view.
  6. Relax and watch what happens. Do mini-meditations or mindful breathing while you're between tasks or in line at the cafeteria.
  7. Get essential nutrients. Go beyond vitamins and begin to think about daylight and laughter as integral parts of your daily life.
  8. Consider what you're consuming. Sugar, caffeine, and alcohol can increase stress levels.
  9. Watch your words. Don't let negative internal chatter and self-recrimination distract and demoralize you.
  10. Be kindDo something nice for a different co-worker every day until it becomes second nature to reduce stress for others.
  11. Sleep on it. Sleep deprivation a major culprit in stress is Try to get restful, restorative slumber every night, and watch your stress level decline.

Group Legal Plans: What's Not To Like?

1More and more businesses are offering workers quality legal services as a voluntary employee benefit, according to a nationwide survey of more than 300 human resource and benefits professionals. The study, sponsored by MetLife, found that the top reasons for the popularity of these services were improved employee satisfaction (69%) higher retention and loyalty (44%), and the ability to compete with other companies' benefit programs (32%). A majority of survey respondents cited these benefits of Group Legal plans:
  • Helping employees achieve peace of mind when dealing with legal issues.
  • Reducing employees' levels of stress.
  • Lowering the cost of legal services.
  • Minimizing workplace time in dealing with personal issues.
  • Providing quality legal services (57%).
More than 90% of survey respondents found that legal plans are easier, or as easy, to administer than other voluntary benefits plans. These programs also have high persistency rates for both employers and employees. Says Bill Brooks, CEO of Hyatt Legal Plans, "This is a benefit that spans the generations and suits a diverse workforce because there's a broad range of situations where an attorney can help. Legal assistance at a cost of less than some attorneys may bill per hour can be an effective way to generate employee loyalty." Keeping Your 'Lone Workers' Safe

1 Some companies employ workers who work alone or in remote areas where injuries and illnesses can occur, resulting in delays in emergency response or medical assistance. They include people who work outside normal business hours, such as janitors, security guards, special production, plant maintenance or repair staff, delivery truck drivers, and others. Protecting the safety of these lone or remote workers isn't always easy - but it's your responsibility. In some cases, you must monitor the exposure of these workers to identify potential hazards, assess the risks of injury or illness, and take steps to eliminate or control them. Bear in mind that some high-risk activities have safety regulations which require at least one other person to do the job, such as confined space work (defined by OSHA regulations) or electrical work at or near exposed live conductors. If you have any employees out in the field or working alone, consider what safety measures to take to protect their well-being and security. A well-thought-out safety program for these employees is an essential first step. Hazard control measures might include:

Your Job Can Save You Money On Auto Insurance!

4Engineers, firefighters, lawyers, teachers, and police officers all have one thing in common: they qualify for Auto insurance discounts with some insurers who have found that people in certain fields tend to be less risky drivers than those in other occupations.

A number of insurance companies offer discounts to those in a variety of professions - everything from architects, CPAs, and college professors through librarians, military personnel, and pilots, to physicians, registered nurses, and scientists.

Here's why: although practicing architecture or flying a plane doesn't necessarily make a driver more responsible, insurance underwriters don't have to prove cause and effect when setting rates. They need only show a relationship between these rating factors and risk.

A variety of factors can come into play in determining discounts. One Auto insurance company offers up to a 5 % discount to first responders, such as firefighters, police officers, emergency medical technicians and paramedics. Because these people tend to work in the communities where they live, they probably don't commute long distances. First responders might speed down the road in emergencies, but not in their own vehicles, and they tend not to work from 9 to 5 - which means that they're at lower risk for accidents.

Discounts vary by occupation, insurance company, and state. Some companies offer discounts for a long list of occupations and professions, while others provide them to only a few, or none at all. Some jobs receive larger discounts than others.

Rules for discounts also vary by field. To qualify for one company's discount, health care providers must have a license to practice, as well as a degree. However, policyholders who have earned at least a bachelor in engineering, math, or science qualify for an 18% discount, even if they work in other fields.

Beware Of Bullies On The Job

3Unfortunately, there are all too many bullies in the workplace -- and, all too often, their abusive behavior has led to violent, even fatal, employee rampages that have made the headlines. It makes sense for business owners and managers to deal with on-the-job bullying before it escalates into a potentially deadly situation. Recognizing a bully in the workplace can be difficult. These people often have "Jekyll and Hyde" personalities: They can be extremely charming, polite, and respectful in public. However, as a rule, bullies: 1) don't believe in following the rules of society; 2) crave negative attention; 3) try to put others down by manipulating and degrading them in front of their peers; 4) seek power; and 5) spread untrue rumors in the workplace, disrespect their victims, and refuse to listen to them. Because there are no federal or state laws against workplace bullying, it might be hard to fire a bully right away. However, there are ways to deal with this problem. Institute a zero-tolerance policy toward bullying. Your employee handbook and codes of conduct should set a clear definition of the consequences and punishment for bullying, with a specific list of actions for dealing with it. Enforce the policy. When it's time to discipline a bully, sit down with the accused person, their supervisor, and someone from your human resources department. If the bully offers to apologize and promises never to repeat the behavior, you might settle the matter by writing a letter of reprimand to be kept in their personnel file. You might also put the employee on probation, with close supervision by their supervisor, and let them know that any further bullying will result in termination.
