    In some cases, the conformation of the condominium and of the condominium parts is such that difficulties may arise in identifying the subjects obliged to pay the condominium expenses relating to some parts of the condominium. This is the case, for example, of the condominium courtyard where there is a building which is accessed through the part (atrium or entrance hall) of the so-called main building. Does the owner of the internal courtyard building have to participate in the costs of rebuilding the roof of the "main" building from which he enters? An examination of the jurisprudence reveals conflicting solutions. According to an orientation dating back to but recalled by a recent Civil Cassation ruling section VI - 07/10/2019, n. 24927 with reference to the roof, a breakdown of the expenditure by zone would not be admissible: that is, it is not possible to place the said expenditure only at the expense of the owners of the real estate units (apartments, cellars, etc.) located in the vertical below the area of ​​the roof to be repaired ( Cass. Civ., Section II, 06/07/1973, n. 1923). The 2019 ruling, confirming the orientation that seems to be the majority one, established that the parts of the condominium building - such as, in this case, walls and roofs pursuant to art. 1117 cc, n. 1(i.e. the works and the sewerages, drainage channels and the like pursuant to art. 1117 cc, n. 3), appointed to preserve the condominium building from atmospheric agents and infiltration of water, rain or underground, fall within the their function necessary for collective use, among common things, the conservation costs of which are subject to the distribution in proportion to the value of the individual exclusive properties, pursuant to the first part of art. 1123 cc, not including, on the other hand, among those parts susceptible of destination to the service of condominiums to a different extent, or to the enjoyment of some condominiums and not of others, as per art. 1123 cc, paragraphs 2 and 3. Indeed, another jurisprudential orientation which, likewise confirms the obligation of all condominiums to participate in the cost of renovating the roof, specifies that in application of the legal criteria for the distribution of expenses, established by paragraph 3 of art. 1123 cc, coordinated with the provisions of art. 1126 cc(on the roof of the roof for exclusive use) the costs of maintenance and conservation of roofs, solar panels and roofs for exclusive use must be shared only by the real estate units that use them, or that fall in whole or in part in their projection vertical, including those that have an indirect advantage, as in the case in which condominium areas or volumes are also covered (for example, hallways, stairs, atriums, porches, courtyards, etc.), all always in proportion to utility who draw from it (Article 1123, paragraph 3 of the Italian Civil Code).Furthermore, as confirmation, article 1117, paragraph 1, of the Civil Code, expressly includes the indication of the roof as a condominium part of the building. Therefore, this portion of the building must be understood as the property of all the condominiums, unless the title (the condominium regulation) provides otherwise. It should be noted, however, that the Court of Cassation in another ruling (more dating back) annulled a sentence of a trial judge who had set the costs of rebuilding the roof and facade of a building with a condominium courtyard in which stood a construction separate from the building also borne by the owners of this building and in proportion to the value of their properties, exclusively enhancing the fact that to access the separate building it was necessary to use the entrance hall of the building and the common courtyard (Cass. civ., Section II, 13/07/1996, no. 6359).
