Ask Your Peers  Faulty Workmanship (Closed)

We have several clients interested in Faulty Workmanship coverage.

Two examples:

1. While buffing floors, a janitorial contractor was not operating the machinery correctly and damaged the wood floor they were working on, resulting in it having to be completely replaced. Not covered as it's part of "Your Work".

2. While installing solar window film, a contractor broke the window and frame with a tool. Not covered as it's part of "Your Work".

Looking for a market to write these types of risks. Any help is appreciated.

Some carriers offer Contractors E&O coverage which would cover faulty workmanship. CNA is the only carrier that I know of that does offer this coverage.

What ever company you are using to write these risk must not be to good writing contractors or they just don't want to pay. Our companies add that in with the liability of the company. Workmanship is probably over 50% of a contractors claim. He will still have a ded so the window probably isnt worth the claim but the floor would be

The CNA program can be accessed from Victor O. Schinnerer. They write Contractors E & O including faulty workmanship. I cannot confirm that the 2 scenarios you mentioned would be covered under their policy, but you can ask the underwriter. Their phone number is 301-961-9800. Send submissions to [email protected].

We have a preferred A-Rated market that includes blanket AI's, 10% commissions, that offers faulty workmanship(Contractor E&O) endorsement with $10k in coverage, along with standard 1M/2M GL limits. They also offer tools coverage($5k limit) as part of their package. Starting premiums around $550.00.

Property damage is typically not covered in smaller contractor programs due to negligence of the contractor. This topic is highly debated, but more than not I am seeing carrier's decline these types of claims, unless faulty workmanship coverage(contractor E&O) is included.

I just wrote a Window installer in up state NY and I had to add an endorsement to cover Faulty workmanship. NY is a very Liberal state and most of the good coverages for contractors have to be added on to the GL

Hi Barb:

Main Street America offers a Limited Property of Others optional endorsement for a nominal charge providing coverage up to $10,000 which eliminates the coverage issues with "Your Work" and "Care, Custody, Control" that are found in all ISO CGL policies. They only require the contractor admit that the damage arose out of their faulty work and not someone elses.

This is an important selling point as most insured's and many agents are not aware of this usually uninsured exposure unless/until they experience a claim.

You have to be extremely careful as to what state this risk is resides since in our state PA, its excluded under the basic GL. I agree Contractors E & O should ( I say should ) cover faulty workmanship. Always subject to a Deductible and affordability subject to the DED can be an issue. Make sure you point that out. CNA has a program.
