I have a client purchasing a building under an LLC. They will be operating a ice cream shop in the building and thus not operating all 12 months of the year. They are indicating 7 months of the year. Is anyone aware of a carrier who would be ok with this situation?

Jeff, a couple of questions: 1) Do you have a carrier who will write a BOP on the building and business? If so BOP's typically don't have a vacancy clause. 2) Is the account Loss Free? This will help you in working with underwriters. 3) Is the Ice Cream Shop and the building written on the same policy?

</br>Depending on the condition of the building a plan that the insured has to maintain the building when it is not occupied companies can add an endorsement to remove the vacancy endorsement or at least modify the impact. If these suggestions will not work contact your local E&S broker they have carriers who will write the coverage for the vacant building typically the premium is 4 times what they would pay for an annual property policy.

</br>Thank you for the information! I the business already has 1 location. I think the plan is to buy the building under an LLC and then we could try to add the second location on to the policy we already have for the first ice cream shop. I think that is the ideal way that they would like it set up. I guess when you consider there is no guarantee that the business will make it they still have coverage on the building under the LLC to rent to someone else.
