INFORMATION DATE 19891003 DESCRIPTION USDOL Program Highlights, Discrimination Protection for Trucking Employees SUBJECT Discrimination protection for trucking employees U.S. Department of Labor Program Highlights Fact Sheet No.OSHA 89-30 DISCRIMINATION PROTECTION FOR TRUCKING EMPLOYEES Surface Transportation Assistance Act of 1982 (STAA) gives the Secretary of Labor authority to investigate complaints by truckers, mechanics, freight handlers, and others involved in interstate trucking who believe they have been discharged or discriminated against for protected safety activities. Since provisions of Section 405 of the STAA covering commercial motor vehicle are similar to nondiscrimination requirements in Section 11© of the Occupational Safety and Health Act of 1970, the Secretary has given OSHA responsibility for investigating these complaints. The Section 405 provisions set forth a longer time period for filing complaints, permit immediate reinstatement of discharged employees, and authorize compensatory damages and attorney's fees for aggrieved employees whose complaints are substantiated. ... bulletin board Self-service can't replace the value or need of the insurance professional. But consumer online access can help agents get rid of an incredible amount of processing activity. For example, as many as six out of 10 phone calls to an agency are billing-related. If customers can access their own billing histories, many of those calls could be eliminated, freeing up hours of productivity for staff. An easy place for any agency to start providing self-service options for its clients is in certificates of insurance. Certificates are a non-revenue-generating activity for agents and a constant source of irritation for clients who can't get them when they need them. This type of self-service gives agents and brokers a competitive advantage by providing 24/7 service without additional staff. It's popular with contractors who are out in the field and truckers who are out on the road during business hours. These groups and others can access certificates of insurance themselves when they're doing paperwork — after hours. Technology allows people to happily fend for themselves in a lot of cases. They don't have to rely on others. It's convenient, always accessible, easy to use, and it's flexible for people with busy schedules. Technology puts them in charge. Agents should never have evolved into order-takers. The agency that keeps engaging primarily in transaction processing will keep losing value, and probably give way to a Web site. But the agency that pays attention to customers' needs and portfolios can use the Internet as a tool, not a competitor. What are some things you don't want to give up as an independent agent? Consultative selling, true ...

... also call this the class of business. A short description of your niche will suffice. For instance, say you're interested in writing artisan and specialty contractors, security guards, general contractors that do residential construction, dwelling policies, or drivers with four accidents in the last three years. Q. What lines of insurance will be offered and at what limits? A. The approach here would be to state that you are interested in writing the Professional Liability for a home inspector or the General Liability for an artisan and specialty contractor. Retail producers should pay careful attention to the line of business and type of coverage required. Also of significance is the amount of the policy limits. Policy limits obviously will vary by class of business. It might be $1 million combined single limit for an independent trucker, or statutory limits for a Nonstandard Auto policy. Producers must do their homework to find out what the policy limits should be. Q. Who are your major competitors? A. The Property/Casualty industry is highly competitive, with many insurance companies operating through independent agents. And since agents represent more than one company, carriers face competition within each agency. Insurers compete with underwriting criteria, pricing, automation, service, and product design. Competition in the Surplus Lines market has stiffened in recent years as standard market capacity increased and prices decreased. Specialty niche insurance programs are equally competitive. When putting together your business plan, be aware of what the competition is doing. Admitted carriers file their programs with the department of insurance. These filings are then made public, but be ...
