Ask Your Peers  Fl- H03 Coverage due to a Power Surge (Closed)

I have a customer that has sustained an electrical surge that has damaged the electrical system powering the well. The surge was not due to a storm. Would this loss be covered under an H03 policy? Universal P&C would not provide an answer.

Hi Lisa.

The HO 3 policy covers "Sudden and accidental damage from artificially generated electrical current. This peril does not include loss to tubes, transistors, electrical components, or circuitry that are a part of the appliances, fixtures, computers, home entertainment units or other types of electronic apparatus."

There is also an exclusion for Power Failure. Power Failure, meaning the failure of power or other utility service if the failure takes place off the "residence premises". But if a Peril Insured Against ensues on the "residence premises", we will pay only for that ensuing loss (but again, see Above, items not covered).

Based on your statement that they rec'd damage to the Electrical System only, that would fall under the items not covered: This peril does not include loss to.... electrical components.

You wouldn't want to advise against a claim, but certainly make the coverage clear to your customer so they may make an informed decision to pursue a claim or not. Also, check for any endorsements that may be on their particular policy that might cover loss due to a surge, as I am addressing the HO3 policy form itself.

Thank you for your response Angie. I read the portion above but it still wasn't clear to me. I called the carrier and they advise to file a claim. I would consider the well part of of the dwelling. The surge damaged all the electrical wiring powering the well. It would have been easier if the surge was due to a storm or lighting but of course it is never the case.

Filing a claim will ultimately get the answer as to whether or not there is coverage. In addressing the coverage provided by the HO3 form based on your original post, Electrical components are NOT covered by a power surge in the ISO HO3 form itself. Hopefully there is an endorsement on the policy or the carrier is feeling generous. Good luck to you and your customer.

Lisa, the loss your client has suffered is covered.

The electrical panel is not a "component" because it is not a part within a device, as are the objects listed in the coverage exception cited above by Angela.
