Okahoma has a new workers compensation law that is causing a lot of turmoil. Among other things, the law changes Oklahoma’s court-based system to an administrative one. The supporters say the change will dramatically reduce workers’ compensation costs to businesses, but opponents have said any cost savings will come at the expense of injured workers. Those oppose have said that this law violates the state Constitution in several ways and should be struck down. The new law was challenged in a lawsuit filed in September. Oklahoma City attorney John McMurry said the lawsuit is not an attack on the Legislation’s attempt to transform Oklahoma’s workers’ compensation system into an administrative system. Instead the lawsuit attacks Provisions of the law that would unconstitutionally delay an injured worker’s access to the state’s court to seek compensation. This would allow employers to “opt-out” of the administrative system and create their own benefit plan for injured workers. I’m a P&C agent and one of my clients recently asked me some questions about the new Obamacare. I found some general information, but maybe some of you can help answer her questions: “How much do you think the cost will be per month with the mandatory health care?” She is 32 and healthy, but she hasn’t carried coverage since 2007. Will this be an issue? What is the penalty fine for not carrying health insurance? Thank you in advance for your help!
